Abstract
Uno de los mayores dilemas de la Filosofía del Derecho se
encuentra en el contenido moral de la ley. Durante siglos, centenares
de autores han discutido sobre si la ley debe tener necesariamente un
determinado contenido axiológico para ser válida, así como sobre la
naturaleza de tal contenido, o si por el contrario basta con que sea
aprobada por los cauces legalmente previstos para su validez. En la
presente obra examinaremos la cuestión con base en el pensamiento
de los más prominentes filósofos del derecho de la actualidad.
One of the greatest dilemmas of the Philosophy of Law is
found in the moral content of the law. For centuries, hundreds of
authors have discussed whether the law must necessarily have a certain axiological content to be valid, as well as the nature of such content, or
whether it is enough for it to be approved by the legally established
channels for its validity. In the present work we will examine the
question based on the thinking of the most prominent philosophers of
law today.
