Abstract
Este trabajo pretende rechazar, desde el punto de vista de la teoría analítica del derecho, la tesis según la cual es necesario que un precedente sea aplicado para existir. Discutiendo algunas tesis de Michelle Taruffo, se analiza qué son los precedentes y en qué sentido se puede decir que existen.
This work aims to reject, from the analytical theory of law point of view, the thesis according to which it is necessary that a precedent be applied to exist. Discussing some thesis of Michelle Taruffo, we analyze what are the precedents and in what sense they can be said to exist.
