Abstract
Tras varios años sin tener un armazón reglamentario acorde a la reforma laboral de 2021, por fin ha visto la luz el RD 1065/2025, que proporciona desarrollo al art. 11 ET. Sin embargo, ese desarrollo no puede considerarse todavía un proceso com-pleto. La regulación del contrato para la obtención de la práctica profesional presenta algunos excesos a los que habrá que hacer seguimiento (periodo de prueba, sin ir más lejos), y también aspectos que no han obtenido el desarrollo que el ET ordenaba o no en toda la concreción que sería deseable. Pero, en términos generales, el contrato puede implementarse sin mayores dificultades en el mercado laboral vigente. No ocurre lo mismo con el contrato de formación en alternancia. Respecto a él, la nueva norma presenta múltiples disfunciones en lo que se refiere a su integración en el sistema edu-cativo reglado. Este trabajo analiza esos desencuentros, poniendo en evidencia que el despliegue de este contrato en dicho entorno requiere de una sincronización de conte-nidos y tiempos con las normas educativas inexistentes por el momento.
Abstract: After several years without having a regulatory framework in line with the 2021 labor reform, RD 1065/2025 has finally seen the light of day, providing development to Article 11 of the Labour Code. However, this development cannot yet be considered a complete process. The regulation of the contract for obtaining professional practice presents some excesses that will need to be monitored (the probationary period, to name just one), as well as aspects that have not received the development that the Workers' Statute mandated, or not to the extent that would be desirable. But, in general terms, the contract can be implemented without major difficulties in the current labor market. The same is not true for the alternating training contract. Regarding it, the new regulation shows multiple dysfunctions concerning its integration into the formal education system. This work analyzes these mismatches, highlighting that the deployment of this contract in that environment requires synchronization of contents and schedules with the educational standards that are currently nonexistent.
