Abstract
En la sociedad actual cada vez es más frecuente la contratación de cuidados por parte de las personas de edad, un supuesto de ejercicio de su capacidad jurídica en un tema de tanta importancia como su derecho a elegir el lugar de residencia y dónde y con quién vivir. La nueva arquitectura jurídica diseñada por la Ley 8/2021 obliga a incorporar al ámbito asistencial estándares de actuación que, alejados del paternalismo propio de un modelo médico orillado por la CDPD, permitan a las personas de edad tomar las decisiones concernientes a los cuidados que precisan de acuerdo con su voluntad, deseos y preferencias. Por ello, se revela necesario afrontar el estudio del consentimiento prestado por las personas de edad en la contratación asistencial, valorando el impacto que en la dinámica contractual del cuidado de este colectivo pueden tener puntos claves de la reforma como son el principio de autonomía decisoria y el juego de la hegemonía de la voluntad en la toma de decisiones.
In today’s society, care contracting by the elderly is becoming more and more frequent, an assumption of the exercise of their legal capacity in a matter of such importance as their right to choose their place of residence and where and with whom to live. The new legal architecture designed by Law 8/2021 makes it necessary to incorporate standards of action in the field of care that, far removed from the paternalism of a medical model that has been sidelined by the CRPD, allow older persons to make decisions concerning the care they need in accordance with their will, wishes and preferences. It is therefore necessary to address the study of the consent given by older persons in care contracts, assessing the impact that key points of the reform, such as the principle of decision-making autonomy and the hegemony of the will in decision-making, may have on the contractual dynamics of care for this group.
