Abstract
En los momentos de crisis económica la acción protectora de la
Seguridad Social toma mayor importancia en la sociedad española, al aumentar el
número de desempleados y con ello el riesgo de sufrir exclusión social. La renta activa
de inserción es el tercer nivel de la acción protectora de la Seguridad Social, con una
regulación propia en el Real Decreto 1369/2006, de 24 de noviembre, que establece en
su artículo segundo los requisitos necesarios que el solicitante debe cumplir para
obtener derecho al programa de renta activa de inserción. El presente artículo analiza los
requisitos necesarios para ser beneficiario, sus recientes reformas y su problemática
interpretativa, que suscita controversias judiciales entre los solicitantes y el Servicio
Público de Empleo Estatal.
In moments of economic crisis the protective action of Social Security becomes more important in spanish society, increasing the number of unemployed and risk of social exclusion. Active insertion income is the third level of the protective action of the Social Security, with self-regulation in the Royal Decree 1369/2006, of November 2, the Royal Decree regulates in his article two necessary requirements that applicants must meet to get the right to active insertion income. The present article analyzes the requirements to be a beneficiary, its recent reforms and its interpretative problems, which raises disputes between applicants and the National Public Employment Service.
