Abstract
En el presente artículo buscamos
reflexionar sobre las bases filosóficas que sustentaron
el surgimiento del constitucionalismo
e inspiran su evolución. Separación de poderes,
democracia representativa y participación directa
de la ciudadanía en la gestión de los asuntos
públicos, garantía de las libertades individuales
y los derechos sociales...son premisas que pueden
desprenderse de un análisis coherente y extensivo
de los valores que han inspirado el fenómeno
constitucional, y que paulatinamente han ido
materializándose de forma cada vez más concreta
en los textos constitucionales y en el discurso de
la doctrina iusfilosófica a lo largo del siglo XX.
Abstract: In the present article we seek to think about the philosophical bases that sustained the emergence of the constitutionalism and they inspire his evolution. Separation of power, representative democracy and direct participation of the citizenship in the management of the public matters, guarantee of the individual freedoms and the social rights ... they are premises that can part with a coherent and extensive analysis of the values that they have inspired the constitutional phenomenon, and that gradually have gone materializing of form increasingly concrete in the constitutional texts and in the speech of the philosophy of law along the 20th century.
