Abstract
Los logros de la Directiva 2006/54/CE en lo que respecta la eliminación de la discriminación directa e indirecta por razón de sexo en el conjunto de los elementos de la retribución no se han visto completamente alcanzados, hecho debido a la escasa transparencia retributiva, la inseguridad jurídica del concepto «trabajo de igual valor» y los farragosos procedimientos para su reivindicación. La imperiosa urgencia de enmendar estos aspectos es patente debiendo reforzarse la aplicación del principio de igualdad de retribución y erradicarse la discriminación retributiva directa e indirecta, cometido al que responde la Directiva (UE) 2023/970.
The achievements of Directive 2006/54/EC regarding the elimination of direct and indirect discrimination on the basis of sex in all elements of remuneration have not been completely achieved due to the lack of remuneration transparency the legal uncertainty of the concept «work of equal value» and the cumbersome procedures for its claim. The urgency of amending these aspects is evident, and the application of the principle of equal pay must be reinforced and direct and indirect pay discrimination must be eradicated, a task to which Directive (EU) 2023/970 responds.
