Con gran orgullo vemos salir este número extra de 2024, dedicado al análisis de la institución del despido en diferentes países de Europa, en que la que, por primera vez, contamos con participación internacional gracias a la colaboración de la European Labour Law Young Scholars (ELLYS) representada por su presidente Fabrizio Ferraro, Profesor que es, a su vez, jefe del Departamento de Dirección Estratégica del IESE Business School de Italia.

    Modalities of dismissal in Serbia.

    The development of any legal institute, as well as the valid form of such an institute, largely depends on the state itself, that is, on its state and social organization, culture, tradition and history. Same can be said about dismissal. In this paper, therefore, various modalities of dismissal in Serbia will be presenteed, both through the eyes of the Labour law, as the main law in the field of labour relations, but also through the practice of Serbian courts. However, the paper will be limited to the issue of dismissal within the sphere of general employment regime, thus leaving out the specifities of special regimes.

    El modelo español de Despido colectivo. Entre adecuación al Derecho de la UE y respuesta a la realidad socioeconómica.

    Sigue abierto el debate en torno a la ordenación jurídica del modelo legal español de Despido Colectivo, tanto en el plano de la dogmática jurídica como en el de política legislativa. En el estudio se plantean algunas de las cuestiones más relevantes, en torno a la conceptuación del despido colectivo, al elemento cuantitativo-temporal del despido y al nacimiento de las obligaciones de información y consulta. Se concluye el estudio con algunas propuestas de futuro con matiz corrector de la actual regulación laboral en España.

    Modalities of dismissal in Italy.

    In Italy the general principle is that the dismissal must be causal. This article analyzes the dismissal reform in Italy, introduced by Legislative Decree no. 23/2015, 7 March.In collective dismissal there is a specific procedure in the case of company relocations apart from the classic collective dismissal due to staff reduction. In the other hand, the reinstatement protection, in a context of dismissal for objective justified reasons, is provided only for the case in which the judge ascertains the lack of justification for the reason consisting in the employee’s physical or psychic disability, assimilating it to the hypothesis of nullity of dismissal. Regarding disciplinary dismissal, a distinction is made between the “giusta causa” and the “giustificato soggettivo motive”.

    Modalities of dismissal in the Republic of Croatia.

    The following paper examines the modalities of dismissal in the Republic of Croatia, providing a comprehensive overview of historical developments, as well as the current legal framework regarding the subject matter. An in-depth analysis of objective, subjective, and collective dismissals will be provided herein, tracing their evolution from the 1990s to present day. The paper highlights key legislative reforms and their impact on employment termination practices, offering valuable insights into the labour law legislation in Croatia regulating the various types of dismissals.
