    The existence of two or more proceedings involving the same cause of action and between the same parties before the courts of different Member States forces a court second seised to decline jurisdiction in favor of the court first seised, ex Art. 27 and 29 of the Brussels I Regulation. But, what happen when the court second seised is the only one which has exclusive jurisdiction ex Art. 22? The ECJ has had the opportunity to clarify this issue quite rightly.
