Abstract
El presente texto, examina la problemática estructural y normativa que afectan a los pequeños municipios y micromunicipios en España, con especial énfasis en la gestión ambiental dentro de un contexto de gobernanza multinivel. Destaca la insuficiencia del principio de diferenciación incluido recientemente en la LRBRL tras la reforma del Real Decreto Ley 6/2023, que no logra ajustarse a la diversidad y limitaciones reales de estas entidades territoriales. Se analiza la complejidad normativa vigente y los obstáculos prácticos para cumplir las obligaciones ambientales, sobre todo debido a la falta de recursos técnicos y financieros. Frente a esta situación, se propone una reforma integral que contemple la incorporación formal del concepto de micromunicipio, la creación de un Estatuto Básico del Pequeño Municipio con un proceso de aprobación bottom-up, y la elaboración de un futuro Real Decreto Legislativo para armonizar la gestión ambiental. Este nuevo marco buscaría fundamentarse en la voluntariedad, eficacia y cooperación interadministrativa, con el objetivo de dotar a estos municipios de mayor autonomía y capacidad para gestionar sus competencias, especialmente las ambientales. Aunque reconoce los desafíos y riesgos, la propuesta apunta a superar la rigidez normativista actual, promoviendo una diferenciación estructural acorde con la realidad heterogénea del territorio español.
Abstract: This text examines the structural and regulatory problems affecting small municipalities and micro-municipalities in Spain, with particular emphasis on environmental management within a context of multilevel governance. It highlights the inadequacy of the principle of differentiation recently included in the LRBRL following the reform of Real Decreto Ley 6/2023, which fails to take into account the diversity and real limitations of these territorial entities. It analyzes the complexity of current regulations and the practical obstacles to complying with environmental obligations, mainly due to the lack of technical and financial resources. In view of this situation, it proposes a comprehensive reform that includes the formal incorporation of the concept of micro-municipality, the creation of a Basic Statute for Small Municipalities with a bottom-up approval process, and the drafting of a future Royal Legislative Decree to harmonize environmental management. This new framework would seek to be based on voluntarism, efficiency, and inter-administrative cooperation, with the aim of providing these municipalities with greater autonomy and capacity to manage their competences, especially environmental ones. Although it recognizes the challenges and risks, the proposal aims to overcome the current regulatory rigidity, promoting a structural differentiation in line with the heterogeneous reality of the Spanish territory.
