Abstract
El presente análisis examina la STSJ Castilla-La Mancha n.º 556/2025, la cual aborda un conflicto de notable densidad jurídica centrado en la extinción de una relación laboral especial penitenciaria por motivos disciplinarios. El caso gira en torno a la alegación de consumo de sustancias estupefacientes por parte de un interno, basada en una prueba toxicológica sin posibilidad de verificación mediante contraanálisis, lo que expone una tensión jurídica relevante entre el ejercicio de la potestad disciplinaria de la Administración penitenciaria y las exigencias constitucionales de garantía procesal, en especial, en el marco del Estado de Derecho. Este escenario permite reflexionar sobre la suficiencia de las garantías procesales ofrecidas en contextos de excepcionalidad como el penitenciario, así como sobre la protección efectiva de los derechos fundamentales de los trabajadores internos. En particular, se plantea el debate sobre la aplicación del derecho a la tutela judicial efectiva, la presunción de inocencia y la función resocializadora del trabajo en prisión, todo ello en el marco del régimen especial regulado por el RD 782/2001.
Abstract: This commentary offers a critical analysis of Judgment STSJ Castilla-La Mancha No. 556/2025, which addresses a legally complex dispute concerning the disciplinary termination of a special prison labor relationship. The case, focused on the alleged consumption of narcotic substances without the opportunity for toxicological counter-analysis, exposes structural tensions in the regulation of prison labor when examined through the lens of the rule of law.This scenario prompts reflection on the adequacy of procedural safeguards in exceptional contexts such as penitentiary institutions, as well as on the effective protection of fundamen-tal rights of inmate workers. Specifically, it raises questions about the application of the right to effective judicial protection (Art. 24.1 Spanish Constitution), the presumption of innocence (Art. 24.2), and the rehabilitative purpose of imprisonment (Art. 25.2), all within the framework of the special legal regime established by Royal Decree 782/2001.
