Utopía y mundo imaginario del derecho

Abstract

In this article it is argued that the most interesting thing about utopia is not its ignorance of reality but the fact that it imagines a world that is of use when comparing and criticising reality. This is followed by an analysis -together with examples of the legal and literary history of Spain- of three dimensions of utopia in regards to law: positive utopias from order, positive utopias against order and negative or empty utopias.

En este artículo se sostiene que lo más interesante de la utopía no es su desconocimiento de la realidad, sino el hecho de que imagina un mundo que sirve para comparar y criticar la realidad. Se analiza seguidamente, con ejemplos de la historia jurídica y literaria española, tres dimensiones de la utopía en relación con el derecho: las utopías positivas desde el orden, las positivas contra el orden y las negativas o vacías.
