    La clasificación inicial en tercer grado de tratamiento penitenciario: desde su contexto legal a su aplicación práctica

    La clasificación penitenciaria basada en el principio de individualización científica es el instrumento jurídico que permite al penado cumplir su pena en el grado penitenciario que más se ajuste a sus necesidades resocializadoras, dando así cumplimiento al fin de reinserción proclamado por la Constitución en su artículo 25.2. Para poder clasificar a un penado inicialmente en tercer grado debe constatarse que es capaz de vivir en semilibertad, conforme a las normas, y para ello es preciso ponderar diversos parámetros, valorándose especialmente su historial delictivo e integración social. Centra su objeto este estudio en la forma que los Tribunales de Justicia tratan este instituto jurídico y en concreto la ponderación de dichos parámetros, junto con otras circunstancias relativas al proceso clasificatorio como son el tiempo de resolución, la posición del Ministerio Fiscal, índice de éxito de los diversos recursos clasificatorios, influencia de la satisfacción de la responsabilidad civil, etc.The inmates classification is based on the individualism scientific principle. This is an instrument which allows the convict to serve a sentence in the most convenient prison system in relation to the social rehabilitation. This is the way to get the rehabilitation of an offender established in the Constitution (Art. 25.2). Before classifying the inmates into the third grade, it is necessary to be sure this person can live in half-freedom, following the rules applied to everyone. So, we need to evaluate several parameters. We will consider particularly the criminal background and the social integration. This study is focused on the way the law courts deal with this legal concept, evaluating the mentioned parameters above and others circumstances related to the qualifying process like the time to resolve, the Prosecutor´s point of view, the successful rate in the different qualifying appeals, the influence in the satisfaction of the accountability, etc.
