A Comissão Técnica Nacional de Biossegurança (CTNbio) enquanto arena de disputa hegemônica

Abstract

O artigo examina a estrutura lógico-operativa, os interesses em disputa e a racionalidade discur- siva que orienta o processo de tomada de decisões na Comissão Técnica Nacional de Biossegurança (CTNBio). Discute ainda como se explica que a CTNBio opere sem qualquer controle democrático, perquirindo o como o órgão concebe a ciência. É utilizado o conceito de Zona de Autarquia. Seu objetivo é investigar se a CTNBio justifica racionalmente suas decisões, com base na lei e no Direito, se estas deliberações possuem um substrato normativo que organize e dê substância à sua funda- mentação e, sobretudo, se há ou não uma aparência de Direito nos argumentos e na racionalidade que fundamenta as deliberações emanadas. Investiga, em caso negativo, em que medida estas deci- sões estão a serviço de criar uma falsa legalidade com o intuito de afastar o controle social sobre as deliberações. No conceito de “Zona de Autarquia”, não obstante existam normas gerais e abstratas que são o importante para o Estado de Direito, os atos de aplicação dessas normas aos casos con- cretos também assumem um papel fundamental na medida em que são comandos dirigidos aos órgãos que têm a competência para utilizá-los na solução desses casos. E estes órgãos devem, igual- mente, zelar pela segurança jurídica, especialmente quando o legislador lhes confere um espaço de discricionariedade para a aplicação do Direito. Suas decisões, portanto, não podem deixar de estar amparadas em uma racionalidade que permita aos destinatários entenderem as razões pelas quais se privilegiou uma determinada solução jurídica em detrimento de outra.

This article examines the logical-operational structure, the interests in dispute and the discur- sive rationality that guides the decision-making process in the National Technical Biosafety Com- mission (CTNBio). It also discusses how it is explained that CTNBio operates without any demo- cratic control, perquiring how the organ conceives science. The concept of Autark Zone is used. Its purpose is to investigate whether the CTNBio rationally justifies its decisions, based on the law of the Right, if these deliberations posses a normative substrate that organizes and gives substance to its grounding and, above all, if there is or not an appearance of law in the arguments and in the rationality that underlies the deliberations. Investigate, if not, to what extent these decisions are in the service of creating a false legality with the intention of deviating the social control over deliberations. In the concept of Autarchy Zone, although there are general and abstract norms that are important for the rule of law, the acts of applying these norms to concrete cases also play a fundamental role in so far as are commands directed to the organs that have the jurisdiction to use them in solving such cases. And these organizations must also ensure legal certainty, espe- cially where the legislator confers on them a discretion for the application of the law. Its decisions, therefore, can not fail to be supported by a rationality that allows the recipients to understand the reasons why one particular legal solution was privileged to the detriment of another.
