La víctima de la violencia familiar en el sistema de Servicios Sociales: un análisis crítico y comparado de la situación en España

Abstract

La presente Tesis Doctoral ha sido concebida, diseñada y ejecutada mediante un estudio cuantitativo, a través de una encuesta planteada a los profesionales de servicios sociales en España, con miras a generar conocimiento sobre la respuesta que la víctima obtiene de la sociedad, en este caso, y de manera más concreta, del profesional del trabajo social. La primera parte de la investigación (capítulos I y capítulo II) constituye una descripción histórico-cultural del fenómeno de la violencia, los conceptos violencia, víctima y agresor, y del origen de la violencia desde distintas perspectivas y disciplinas, en este caso de la filosofía, la antropología y la criminología. Para hablar de violencia familiar y poder caracterizarla, distinguiremos entre violencia de género, doméstica y familiar. Analizaremos la violencia atendiendo a quién la realiza, a cuándo se realiza o a cómo se lleva a cabo, para terminar con unas pinceladas sobre los factores de riesgo en estos tipos de violencia y las consecuencias de la misma. El capítulo III pretende aportar un conocimiento sobre qué son los servicios sociales en España y cómo se estructuran, así como los distintos recursos de los cuales se dota para dar respuesta a la violencia en el ámbito familiar, cuyo análisis se plantea al inicio del mismo. El estudio es exploratorio, de carácter cuantitativo, y busca conocer las propiedades importantes del fenómeno. Tras plantear tres objetivos de investigación y la metodología (capítulo IV), se describen los resultados obtenidos en el análisis de la información que ha resultado, atendiendo a cómo es el trabajador social encuestado, su formación específica en violencia familiar, concluyendo con el perfil de las víctimas en riesgo de sufrir la violencia familiar (capítulo V). Finalmente, en el capítulo VI se plantean las conclusiones donde se presentará el perfil socio-demográfico de la víctima, la tipología de la violencia y las relaciones de parentesco que unen a la víctima con su agresor. En segundo lugar se dará a conocer cómo es el profesional del trabajador social encuestado, desde dónde se ejerce, el número de atenciones en violencia familiar que realiza al año, cómo son los usuarios víctimas de la violencia familiar y qué respuesta se le está dando. En relación al objetivo de formación específica veremos cómo el profesional que ha participado de nuestra investigación está, en su mayoría, formado para la intervención, y se siente capacitado para llevarla a cabo. Terminaremos este trabajo con catorce propuestas, encabezadas por la creación de la Ley de Violencia Familiar y su consecuente protocolo de intervención único. The present Doctoral Thesis has been conceived, designed and executed by means of a quantitative study, by a survey made to the professionals of social services in Spain, to bring attention and knowledge on the response that the victim obtains from society, in this case, and more specifically, from social work’s professionals. The first part of the investigation (chapter I and chapter II) constitutes a historical - cultural description of the phenomenon of the violence, the concepts violence, victim and aggressor, and of the origin of the violence from different perspectives and disciplines, in this case from philosophy, anthropology and criminology. To talk about familiar violence and to be able to characterize it, we will distinguish between gender, domestic and familiar violence. We will analyze the violence focusing on who realizes it, when it is realized or how it is carried out, to end with a few strokes on the risk factors in these types of violence and their consequences. The chapter III tries to shed some light on what are the social services in Spain and how they are structured, as well as on the different resources with which it is provided in order to respond to violence in the familiar environment, which analysis appears at its beginning. The study is exploratory, of quantitative character, and seeks to know the important properties of the phenomenon. After setting out three research objectives and the methodology (chapter IV), the results obtained in the analysis of the information that has resulted are described, focusing on how the polled social worker is, its specific formation in familiar violence, concluding with the profile of the victims in risk of suffering familiar violence (chapter V). Finally, in chapter VI we contemplate the conclusions where the social-demographic profile will be presented, the typology of the violence and the kinship that connects the victim with its aggressor. Secondly, we will see how the polled social worker is, where from they practice their role, the number of attentions in familiar violence that they realizes a year, how the users victims of familiar violence are and what kind of answer they are being given. Regarding the objective of specific formation, we will see how the professional who has taken part of our investigation is, in most cases, trained for the intervention, and feel qualified to carry it out. We will finish this work with fourteen proposals, headed by the creation of the Law of Familiar Violence and its only consistent protocol of intervention.
