El regimen de compatibilidad de las prestaciones de Seguridad Social con el trabajo

Abstract

En el siguiente trabajo se analiza la posibilidad de compatibilizar el percibo de una prestación contributiva del sistema de Seguridad Social con el ejercicio de una actividad profesional, ya sea por cuenta ajena o por cuenta propia, con el fin de conocer si el legislador ha sabido adaptar la normativa y entender las nuevas formas de organización del trabajo, así como si habrá logrado cubrir las necesidades de los individuos en una sociedad con un mercado laboral cada vez más inestable, una tasa de paro cada vez más alta y un envejecimiento de la población que hace peligrar la viabilidad del sistema de pensiones. Para ello, examinaremos las distintas prestaciones ofrecidas por nuestro sistema público de manera individualizada, pero tratando de seguir un método de análisis común en todas ellas. En primer lugar, expondremos la situación actual en la que se encuentran estas para ser conocedores de su evolución y analizar su correcta adaptación a las nuevas realidades, se estudiará el régimen jurídico de compatibilidad de las mismas para conocer las distintas posibilidades existentes que permiten compaginar una de estas prestaciones con la realización de un trabajo, y por último, se aportarán posibles alternativas regulatorias al actual régimen de compatibilidad.

The present work analyses the possibility of combining the receipt contributory benefit of Social Security system and the exercise of one professional activity, either self-employed or as an employee, in order to know if the legislator has been able to adapt the regulations and understand the current new ways of work organization, as well as if is able to meet the needs of individuals in a society with a job market increasingly unstable, an unemployment rate increasingly high and an ageing of the population that makes destabilize the viability of the pensions system. For that reason, the different benefits offered by our public system will be examined individually but through a common method of analysis. In the first place, the current situation in which these are found will be explained in order to be aware of their evolution and to analyse the correct adaptation to the new realities, the legal system of compatibility of such situations will be studied to know the different options available that allow to combine one of these benefits with the execution of a job, and finally, possible alternatives to the current compatibility regime will be provided.
