La privación de la patria potestad o la inhabilitación para su ejercicio como medida reduccionista de la pena de prisión en el marco de la mediación

Abstract

Los hijos no emancipados están bajo la patria potestad de los progenitores. El padre o la madre podrán ser privados total o parcialmente de su potestad por sentencia fundada en el incumplimiento de los deberes inherentes a la misma o dictada en causa criminal o matrimonial. En causa criminal son privativas de derechos: la inhabilitación para el ejercicio de la patria potestad y la privación de la patria potestad. La justicia restaurativa, concretamente la mediación penal, es un instrumento para reparación del daño causado. De lege ferenda, en interés del menor, podrá reducirse la pena de prisión por la imposición o aumento de las penas privativas de derechos relativas a la patria potestad en el marco de la justicia restaurativa.

The non-emancipated children shall be under the parents’ parental authority. The father or the mother may be deprived in whole or in part of their authority pursuant to a judgement on grounds of the breach of the duties inherent thereto, or issued in criminal or matrimonial proceedings. In criminal proceedings, are penalties of deprivation of rights: the special barring of parental rights and the deprivation of parental rights. The restorative justice, specifically victim-offender mediation, it is a tool to repair the harm they've done. De lege ferenda, in the interest of the child, it may be reduced the prison sentence for the imposition or increase of disqualifications relating to parental authority within the framework of the restorative justice.
