Título: El proceso declarativo de revisión

Resumen: * Objetivos: El tema de tesis doctoral que bajo el título “El proceso declarativo de revisión” se pretende defender y cuyo texto se presenta a examen, ha sido de gran interés por cuanto nos encontramos con una figura procesal con enormes lagunas en materia de regulación legal, así como por la falta de criterios unánimes por parte de la jurisprudencia a la hora de dar un concepto, buscar su finalidad, determinar la naturaleza jurídica de la misma, analizar cada uno de los motivos taxativamente enumerados en la Ley Procesal, con especial referencia a la idea de documento o a lo que ha de entenderse por maquinación fraudulenta, o delimitar cuál habrá de ser el órgano competente para su conocimiento o quién se encuentra legitimado para interponer una demanda de revisión. La revisión de sentencias firmes constituye una de las instituciones más características del Derecho Procesal en el ámbito jurisdiccional civil, por cuanto supone una enervación del principio de seguridad jurídica consagrado en nuestro ordenamiento jurídico. * Metodología: Deben destacarse seis apartados, el primero conceptúa la figura de la revisión atendiendo a su naturaleza, finalidad y retrospectiva histórica; el segundo relativo a los presupuestos procesales que van a condicionar la admisibilidad o válida emisión de la sentencia que ha de resolver el conflicto jurídico material planteado, y que ha de concurrir en el momento del acceso de las partes al proceso, con especial referencia al órgano jurisdiccional que ostenta la competencia para conocer de la demanda de revisión; el tercero, enfocado al estudio del elemento subjetivo del proceso de revisión, esto es, los sujetos legitimados tanto desde el punto de vista activo, como pasivo; los apartados cuarto y quinto se ciñen al estudio del objeto de esta modalidad procesal, con un análisis pormenorizado del petitum, con un examen de las resoluciones susceptibles de ser revisadas después de haber alcanzado firmeza, y de la causa petendi, haciendo exégesis detallada de cada uno de los motivos de revisión, así como la interpretación dada por la jurisprudencia del Tribunal Supremo y del Constitucional, desde un punto de vista crítico; para finalizar en el apartado sexto, y con el objeto de que el análisis de este proceso declarativo de impugnación autónomo sea lo más práctico y útil posible, se realiza una exposición sobre cuál ha de ser el procedimiento para que pueda prosperar la revisión, a saber: plazos, fundamentación de la demanda y efectos legales que produce desde el momento mismo de su presentación.. El interés que suscitó en la doctoranda el tema propuesto en esta tesis doctoral es capital, tanto jurídica como socialmente en aras a dar respuesta científico práctica a la dicotomía entre la seguridad jurídica -derivada del hecho de que una sentencia ya ha alcanzado firmeza-, y la justicia -cuando dicha sentencia no obstante ser firme ha sido ganada de forma no ajustada a derecho-. Era necesario afianzar el alcance y contenido de esta figura procesal en la práctica y la aportación de soluciones de lege ferenda para evitar lagunas que impidan al justiciable hacer prevalecer la justicia hasta el extremo. * Conclusiones: Del estudio llevado a cano finalmente hemos concluido afirmando que la revisión es un proceso declarativo autónomo y extraordinario de impugnación, encaminado o dirigido a anular un proceso finalizado con sentencia firme al haber sido obtenida con vulneración del más elemental derecho a un juicio justo, haciendo decaer el principio casi absoluto de irrevocabilidad de los fallos que han alcanzado firmeza, primando la justicia frente a la seguridad jurídica, como último y único remedio procesal en aras a la conquista del derecho fundamental a la tutela judicial efectiva. Siendo por ende el fundamento de la revisión hacer prevalecer la justicia frente a la seguridad jurídica, y su finalidad la de expulsar del sistema jurídico un proceso consolidado cuya sentencia que devino firme fue obtenida de forma no ajustada a derecho. * Aims: The doctoral thesis entitled: “the review action” which I Intend to defend and whose text is submitted for exam, has a great interest, hence we find a procedural item which contains huge legal loopholes in the matter of legal regulation, as well the lack of unanimous viewpoints by the side of case law in order to define a concept, search its aim, determine its juridic nature, analyse each of specific enumerated reasons in the procedural law, with a special reference to the idea of document or to what we have to understand as fraudulent machination or define which must be the legally qualified body for notice or who is entitled to bring an action of review. Review of final judgements beyond appeal levies one of the important principles of Procedural Law in Civil matter, because it supposes an enervation of the principle of legal certainty mentioned in our legal system. * Methodology: We must emphasize six sections, first one describes the item of review on the basis of its nature, aim and historical background; second one related to the rules of procedure which entail the admissibility or valid delivery of the judgement which has to solve the raised material legal conflict, and which must come in the moment of the access of the parties into the proceeding, special reference to the court which holds the authority to bring the action of review; third one, focused on the study of the subjective element in the action of review, it is to say, the subjects who are entitled from the active and passive viewpoint; sections fourth and fifth focus on the study of the object of this procedural modality, with a detailed analysis of petitum, an examination of resolutions susceptible of being reviewed after final judgement beyond appeal, and the causa petendi by making a detailed exegesis of each one of the review reasons, and also the interpretation of the case law made by the Supreme Court and the Constitutional Court, from a critical viewpoint; to end on the section sixth, and the aim that the analysis of this autonomous proceeding of appeal can be the most practical and possible useful, it is exposed what must be the procedure for the review in order to become successful, namely: delays, legal reasons for the action and legal effects which brings from the very moment of its filing. The interest raised on the doctoranda the proposed matter in this doctoral thesis is essential, in a legal and social way, in order to give a scientific and practical answer to dicotomy between legal certainty -derived from the fact that it is a final judgement beyond appeal-, and justice -when this judgement, spite of being a final judgement beyond appeal, it was delivered not according to law-. It has been necessary to reinforce the extent and contents of this procedural item in practice and the contribution of de lege ferenda solutions to avoid loopholes which can obstruct the party to court proceedings from succeeding justice in all ways. * To conclude: From the carried out study we finally conclude by affirming that review is an autonomous action and extraordinary in appeal, designed or directed to deem a proceeding ended in a final judgement because it was obtained by infringing the more elemental right to a just proceeding, by losing the almost absolute principle of irrevocability of final judgement, having priority justice face to legal certainty, as a last and sole procedural remedy in order to conquer the fundamental right to effective protection of the court. Therefore, the basis of the review is to succeed justice face to legal certainty, and the aim is to eject from the legal system a consolidated proceeding when the final judgement has been obtained in a way not according to law.
