Abstract: La regulación de la criminalidad organizada en el Código penal español amplía exageradamente la intervención penal hasta considerar delictivos hechos de escasa peligrosidad, acaba determinando unas consecuencias punitivas extremadamente severas, es contradictoria en sus objetivos y adolece de importantes defectos técnicos. Por todo ello, se hace necesaria y urgente la reconsideración de la misma.
The fact that organized crime regulation established in the Spanish Criminal Code overly extends criminal prosecution, to the extent of considering punishable events that suppose little or no hazard, results in extremely severe punitive consequences and practices, and hence, is an obstacle to fulfill its purposes and reveals significant technical defects. Therefore, the Spanish Criminal Code should be urgently and appropriately reviewed.
