| Resumen: | El presente trabajo tiene por objeto realizar un análisis crítico de las cuestionesplanteadas ante el TJUE y la respuesta de este a las mismas en dos recientespronunciamientos, en aras a la clarificación de dichos aspectos, aportando conello criterios de interpretación del RGPD; así como aportar una perspectivacomparada entre la doctrina ya asentada del Alto Tribunal Europeo y nuestroTribunal Supremo en algunos puntos en los que puede existir discordancia decriterios. ---------------------- The present work aims to make a critical analysis of the questions raised beforethe CJEU and its response to them in two recent pronouncements, in order toclarify these aspects, thus providing criteria for the interpretation of the GDPR;as well as to provide a comparative perspective between the already establisheddoctrine of the European High Court and our Supreme Court on some pointswhere there may be disagreement in criteria. |
