La acción y el procedimiento de nulidad administrativa en materia de marcas

Abstract

Las líneas que siguen están dedicadas a la nulidad administrativa de las marcas españolas en vía directa, incorporada al sistema marcaría español el 14 de enero de 2023 por el apartado vigésimo séptimo del artículo 1 del RDL 23/2018. de 21 de diciembre, de transposición de directivas (entre otras) en materia de marcas. Esta modificación pone fin a la atribución del control de validez de las marcas a los juzgados de primera instancia y más adelante a los juzgados de lo mercantil. Traslada el juicio de nulidad en vía directa al ámbito administrativo y, en particular, los confía a la OEPM; en vía de reconvención continúa en primera instancia en el ámbito jurisdiccional. Con esta modificación está vinculada la Lev Orgánica 7/2022. de 27 de iulio, de modificación de la Lev Orgánica 6/1985. de 1 de iulio. del Poder Judicial, en materia de Juzgados de lo Mercantil, que atribuye a las Audiencias Provinciales conocer en el orden civil de la impugnación de las resoluciones de la OEPM que pongan fin a expedientes sobre reconocimiento y mantenimiento de la protección de las modalidades de propiedad industrial que gestiona la Oficina, incluidas las que decidan expedientes de nulidad de las marcas. A continuación se estudiarán solo la acción y el procedimiento de nulidad administrativa de marcas españolas, y en particular la legitimación y plazo de ejercicio de la acción de nulidad administrativa, y sobre el expediente de nulidad administrativa, con especial atención a su solicitud, sustanciación y resolución, así como a las situaciones de conexión entre expedientes de nulidad administrativa y entre estos y procesos civiles que tengan por objeto la nulidad o cualquier otro aspecto que pueda conducir a la extinción de la marca. -----------------

The fines that follow are dedicated to the administrative nullity of Spanish trademarks, incorporated into the Spanish trademark system on January 14, 2023 by section twenty-seven of article 1 of RDL 23/2018, of December 21, regarding the implementation transposition of directives (among others) regarding trademarks. The new /egislation puts an end to judicial control of the validity of trademarks, as it was initial/y designed, by transferring the independent nullity proceedings to the administrative sphere and, in particular, by entrusting this control to the SPTO. The decision over the trademark nullity claimed by means of a counterclaim filed in infringement proceedings continues in the first instance in the jurisdictional field. This is linked to Organic Law 7/2022, of Ju/y 27, amending Organic Law 6/1985, of Ju/y 1, of the Judiciary, in matters of Commercial Courts, which attributes to the Provincial Courts in the civil order the jurisdiction over the challenge of the resolutions of the SPTO that put an end to files on recognition and maintenance of the protection of the modalities of industrial property that the Office manages, including those that decide files of invalidity of trademarks. In the pages below, I wi/1 exclusive/y address the action and procedure for administrative nullity of Spanish trademarks, and in particular the standing to and term of file the administrative nullity action, as we/1 as the administrative nullity file, with special attention to its request, substantiation and resolution, the relationship between administrative annulment files and between these and civil processes that have the object of annulment or any other aspect that may lead to the cancellation of the trademark.
