La ejecución de la resolución de responsabilidad patrimonial en vía administrativa contra terceros.

Abstract

El presente trabajo pretende estudiar el camino a seguir en aquellos supuestos en los que la responsabilidad patrimonial de la Administración se imputa a algún tercero particular, fruto de su participación en la provocación del daño y su vinculación con la actividad administrativa. Se trata de una de las problemáticas más acuciadas de esta tipología de procedimiento administrativo, dado que ni la jurisprudencia, ni los órganos consultivos, como tampoco la doctrina científica han llegado a un consenso sobre la forma de actuar. Por un lado, se analizan las diferentes corrientes interpretativas sobre las posibilidades que tiene la persona interesada para hacer efectivo su derecho a ser resarcido de los daños y perjuicios causados por la actuación administrativa cuando la responsabilidad es imputable a un tercero. Y, por otro lado, la idea-fuerza del presente trabajo defiende la posibilidad de que la Administración ordene y, en su caso, ejecute, el pago de la indemnización a la persona perjudicada a costa del tercero responsable, sin que quepa su derivación a la jurisdicción civil ni otras soluciones intermedias. Esta perspectiva pone de manifiesto, además, la necesidad de repensar la participación del tercero en este procedimiento como un interesado cualquiera, con el correspondiente reconocimiento de las mismas garantías procedimentales que cualquier otro interesado principal.

This paper aims to study the path to follow in those cases in which the liability of the Administration is imputed to a particular third party, as a result of its participation in causing the damage and its link with the administrative activity. This is one of the most pressing problems of this type of administrative procedure, since neither the case law, nor the advisory bodies, nor the scientific doctrine have reached a consensus on how to proceed. On the one hand, the different interpretative currents on the possibilities that the interested party has to make effective its right to be compensated for the damages caused by the administrative action when the liability is attributable to a third party are analyzed. And, on the other hand, the main idea of this paper defends the possibility of the Administration ordering and, where appropriate, enforcing the payment of compensation to the injured party at the expense of the responsible third party, without the possibility of referral to the civil jurisdiction or other intermediate solutions. This perspective also highlights the need to rethink the participation of the third party in this procedure as any interested party, with the corresponding recognition of the same procedural guarantees as any other main interested party.
