De nuevo con la educación diferenciada.

Abstract

La educación diferenciada ha sido y sigue siendo un tema polémico y de fuerte carga ideológicaque supone confrontación. En este artículo se analiza la regulación de la educación diferenciada en las diferentes leyes educativas,así como la jurisprudencia del Tribunal Constitucionalal respectohaciendo especial hincapié y reflexionando sobre las sentencias resolutorias de los recursos de inconstitucionalidad interpuestos contra los preceptos reguladores de la educación diferenciada en la LOMCE y la LOMLOE.Como se verá el planteamiento último en torno a la educación diferenciada gira en torno a una cuestión que esla siguiente¿puedeel legislador prohibir la financiación, el acceso al régimen de conciertos a un centroeducativocuyo titular opta como modelo pedagógico por el de educación diferenciada si este modelo es constitucional?Junto a esta cuestión se plantean otros interrogantes¿es legitima la decisión de prohibir la financiación pública a un modelo educativo simplemente porqueel legisladorconsidere queotro, elde coeducación,cumple mejor los valores del artículo 1.1 CE?; ¿resulta esta decisión contraria al principio de igualdad?; ¿se vulnera la libertad de enseñanza?Como veremos la cuestión no es pacífica habiendo división incluso entre lospropiosmagistrados del TC, habiéndose dictado, por el mismo Tribunal y en tan solo 5 años,una jurisprudenciaque resultacontradictoria frente a la cual además se han formuladodiversos votos particulares, lo cual pone de manifiestoel carácter controvertido de la materia.

Differentiated education has been and continues to be a controversial and strong ideological charge issue that involves confrontation. This article analyzes the regulation of differentiated education in the different educational laws as well as, after a brief analysis of the jurisprudence issued in this regard by the Supreme Court, the jurisprudence of the Constitutional Court with special emphasis and reflecting on the rulings of the Unconstitutionality appeals filed against the regulatory precepts of differentiated education in the LOMCE and LOMLOE. As will be seen, the latest approach to differentiated education revolves around a question that is, to what extent can the legislator prohibit financing, access to the concert regime to a center whose owner opts for education as a pedagogical model? differentiated if this model is constitutional?Along with this question, other questions arise: is the decision to prohibit public financing of a model legitimate simply because the legislator considers that another model, that of coeducation, better complies withthe values of Article 1.1 CE?Is this decision contrary to the principle of equality?; Is the freedom of education violated? As we will see, the issue is not peaceful with division even among the TC magistrates themselves, having been issued, by the same Court and in just 5 years, a jurisprudence that is contradictory against which various particular opinions have also been formulated, which highlights the controversial natureof thematter.
