La trata de menores sin referentes familiares y nacionales de terceros países que huyen de Ucrania : aspectos para su protección en España bajo un enfoque de infancia.

Abstract

Este artículo examina las respuestas de España a la llegada de infancia migrante nacional de terceros países y sin referentes familiares desde Ucraniadesde el inicio del conflicto con Rusia en febrero de 2022. La literatura parecesugerir que determinadas características de esta infancia podrían hacerla más vulnerable a sufrir la trata de personas en sus distintas vertientes. El estudio se centrará en el análisis de las respuestas de la administración española a la trata de esta infancia abordando las siguientes cuestiones.Primero, se estudiael concepto de vulnerabilidad y se analizará cómo la misma podría favorecer situaciones de trata de menores, especialmente en contextos de conflicto.Después, se analizará si la recientemente activada Directiva De Protección Temporal resulta una herramienta efectiva para proteger a esta niñez o si será necesario recurrir a la protección brindada por otros instrumentos jurídicos como la Protección Internacional. Asimismo, se propondrán medidas concretas para garantizar que esta infancia sea considerada como tal antes que personas extranjeras. El estudio seguirá un enfoque interdisciplinar integrando enfoques jurídicos y sociológicos, así como una perspectiva de derechos humanos y de infancia.

This paper looks at the responses of Spain to the arrival of unaccompanied migrant minors fleeing the conflict in Ukraine with a focus onthe situation of Third Country Nationals. There are studies that suggest some characteristics of this childhood may intersect and make them more vulnerable to trafficking of human beings in its multiple aspects. The paper will focus on Spain as the receiving country and tackle the subject of trafficking of these unaccompanied minors in two steps: Firstly, the author will study the concept of vulnerability and how it might be linked to trafficking and intensified inwar times. Secondly, it will analyse whether the recently activated Temporary Protection is an effective tool to protect these unaccompanied childrenon the move with respect to other tools such as the asylum laws. Finally, specific measures will be proposed for the implementation of a specific protective framework in Spain to ensure that children are always considered as such rather than foreigners. The paper will pursue an interdisciplinary perspective, integrating approaches from sociology and legal studieswith ahuman rights and child approachto the interpretation of the law.
