dc.description.abstract | El desarrollo del crowdfunding financiero plantea, entre otros interrogantes, el proble-ma de determinar cómo han de incidir en este ámbito las normas sobre protección del consumidor, no solo respecto a los inversores (cuya protección se viene articulando legalmente sobre la base de los ins-trumentos y categorías propias del mercado financiero), sino también respecto a aquellos consumidores que recurren a esta vía para financiar proyectos de carácter no empresarial (respecto de los cuales se plantea, en particular, la cuestión de la aplicabilidad de las normas sobre crédito al consumo). Todo ello, teniendo en cuenta las peculiaridades del crowdfunding como sistema de financiación en el que, junto a promotores e inversores, asume un papel protagonista la plataforma intermediaria. En este trabajo analizamos la respuesta que los legisladores españoles y europeos han venido dando a las cuestiones planteadas, dando lugar, en el momento actual, a una situación de notable incertidumbre. | es |

dc.description.abstract | The development of financial crowdfunding raises, among other questions, the problem of determining how the rules on consumer protection should affect this area, not only with respect to investors (whose protection has been legally articulated on the basis of the instruments and categories of the financial market), but also with respect to those consumers who resort to this channel to finance projects of a non-business nature (with respect to which, in particular, the question of the applicability of the rules on consumer credit arises). All this, taking into account the peculiarities of crowdfunding as a financing system in which, together with project-owners and investors, the intermediary platform assumes a leading role.
