Neurociencia y derechos humanos: rama del bioderecho para fundamentar el derecho.

Abstract

La filosofía moderna que sustenta el derecho, estableció que la razón lógica es el criterio de verdad, ante ella, el autor español Xavier Zubiri, construyo la metafísica madura a partir de la neurociencia naciente de su tiempo y la mecánica cuántica, su filosofía sirve como fundamento de la teoría iberoamericana, por otro lado, la neurociencia como rama del conocimiento nació en 1960, al descubrir científicos de diversas ramas la necesidad de multidisciplinariedad para conocer el comportamiento humano a partir del sistema nervioso central, en esta investigación, se expone el derecho, la revolución filosófica de la metafísica madura, el nacimiento reciente la neurociencia como disciplina del conocimiento, los avances de la neurociencia en los últimos 20 años, el estado de la cuestión de la relación neurociencia-derecho y las principales discusiones en cuanto a su futuro. Se coloca al final, la reflexión sobre propiciar fundamentos desde la neurociencia hacía un derecho futuro, tema que ha sido poco discutido en el ámbito jurídico.
