Resumen: | La reforma llevada a cabo por la Ley 8/2021, de 2 de junio, reconoce a las personas con
discapacidad el derecho a la toma de sus propias decisiones con pleno respeto a su voluntad, deseos y
preferencias si bien, cuando presenten limitaciones intelectivas, el ejercicio de tal derecho precisará el
apoyo de una persona que ella misma ha podido elegir o, en su defecto, la prevista por la norma. Esta
nueva realidad jurídica desplaza el centro de atención, de la exteriorización del acto en que interviene la
persona con discapacidad al proceso de formación de su voluntad, del que va a depender que emita
consentimiento vinculante en los ámbitos que requieran de su intervención. Reconocida su capacidad
jurídica en igualdad de condiciones con los demás en todos los aspectos de la vida, la persona con
discapacidad psíquica deberá afrontar, con la ayuda de la persona que le presta el apoyo, un proceso
deliberativo que le permita adoptar una decisión consciente y libre. Y si ello no fuera posible, la decisión
la tomará el apoyo reconstruyendo cuál sería su voluntad si pudiera tomarla sin representación. El juicio
sobre el discernimiento de la persona corresponderá hacerlo al notario lo que lo convierte en pieza
fundamental en la aplicación de la reforma. The reform carried out by Law 8/2021, of 2 June, recognises the right of persons with disabilities to make their own decisions with full respect for their will, wishes and preferences. However, when they suffer from intellectual limitations, the exercise of this right will require the support of a person of their own choosing or, failing that, a person determined by law. This new legal reality shifts the focus of attention from the externalisation of the act in which the person with disabilities intervenes to the process of forming their will, on which it will depend whether they can issue a consent that binds them in the areas that require their intervention. Once their legal capacity is recognised on an equal footing with others in all aspects of life, the person with a mental disability must, with the help of the person providing support, undertake a deliberative process that will enable them to make a conscious and free decision for themselves. If this is not possible, the decision will be made by the support person by reconstructing what his or her will would be if he or she could make it without representation. The judgement on the person's discernment will be made by the notary, which makes him a fundamental part of the implementation of the reform. |
