Abstract
Este trabajo se ocupa del tratamiento de las cuestiones de Derecho internacional privado
relativas a las operaciones contractuales complejas o conjuntos de contratos, fundamentalmente de las
formadas por un contrato marco y varios contratos de aplicación. A diferencia de otros trabajos sobre el
tema, se centra en su regulación en los Reglamentos nº 1215/2012 y nº 593/2008. Se concluye que tanto
la competencia judicial internacional como la ley aplicable se han de determinar “contrato por contrato”
en el sentido europeo de este término, y no respecto a la operación compleja en su conjunto.
This work deals with the private international law issues related to contractual complex transactions, namely those composed by a framework contract and several implementation contracts. Unlike previous papers on the matter, it focuses on European private international law instruments Regulation n. 1215/2015 and Regulation n. 593/2008. It is concluded that both international jurisdiction and applicable law shall be determined “contract by contract”, in a European sense, and not in relation to the complex transaction as a whole.
