Abstract
La atribución de legitimación activa a las organizaciones sindicales en el orden social se efectúa en reconocimiento a la función proactiva que la Constitución asigna a los sindicatos para la defensa de los intereses económicos y sociales que les son propios. Dicha legitimación no se limita al proceso laboral; los sindicatos se encuentran también legitimados en otros órdenes jurisdiccionales (civil, contencioso-administrativo e incluso penal), en los que se pueden plantear conflictos que afectan a las personas trabajadoras. La posible legitimación del sindicato para la defensa de los intereses que les son propios, se ha planteado incluso en sede constitucional. Sin embargo, la configuración legal de dicha legitimación se efectúa en diferentes términos en cada uno de los órdenes, y existen ciertas resistencias a una interpretación amplia de la noción de interés legítimo a efectos procesales. En el presente estudio, se analiza la normativa y la doctrina judicial y constitucional recaída en materia de legitimación procesal de las organizaciones sindicales extramuros del orden social. -------------
The attribution of active legitimation to trade unions before social courts is carried out in recognition of the proactive role that the Constitution assigns them in the defence of their own economic and social interests. Such faculty is not limited to the labour procedure, since unions are also legitimized in other jurisdictional orders (civil, contentious-administrative and even criminal), in which conflicts affecting workers may arise. The possible legitimization of unions for the defense of workers’ interests, has been raised even in constitutional appeals. However, the legal configuration of such legitimation is carried out in different terms in each of the jurisdictional orders, and there is some resistance to a broad interpretation of the notion of legitimate interest for procedural purposes. This study analyzes the legal regulations as well as judicial and constitutional doctrine regarding the procedural legitimacy of trade unions outside the walls of the social jurisdiction.
