Abstract
Este artículo profundiza en el papel de los grupos vulnerables frente al cambio climático en el marco jurídico español, europeo e internacional. A partir del principio de vulnerabilidad climática, se estudia cómo los poderes públicos deben ejercer un deber de cuidado hacia colectivos especialmente expuestos a los impactos ambientales. El artículo examina el reconocimiento normativo de estos colectivos en tratados internacionales como el Acuerdo de París, el Convenio de Escazú o el programa ACE de Naciones Unidas, donde se refuerza la participación ciudadana y la justicia climática. En el ámbito español, se analiza la Ley 7/2021 de Cambio Climático, el Plan Nacional de Adaptación, la Estrategia de Transición Justa y el Plan Social para el Clima, destacando sus avances pero también sus carencias en la identificación y protección efectiva de los grupos vulnerables. Se propone una mejora en la concreción de los criterios sociales, superando la mera visión económica de la vulnerabilidad, e incluyendo indicadores específicos para colectivos como los jóvenes o las personas dependientes.
Abstract: This article explores the role of vulnerable groups in the context of climate change within the Spanish, European, and international legal frameworks. Based on the principle of climate vulnerability, it examines how public authorities must exercise a duty of care toward communities that are particularly exposed to environmental impacts. The article reviews the normative recognition of these groups in international treaties such as the Paris Agreement, the Escazú Agreement, and the United Nations ACE programme, which reinforce citizen participation and climate justice. At the national level, it analyses Spain’s Climate Change and Energy Transition Act (Law 7/2021), the National Adaptation Plan, the Just Transition Strategy, and the Social Climate Plan, highlighting both their progress and their shortcomings in identifying and effectively protecting vulnerable groups. The article calls for greater clarity in defining social criteria, moving beyond a purely economic understanding of vulnerability and incorporating specific indicators for groups such as young people and persons with dependency needs.
