Abstract
Por expreso mandato legal, los juzgados y tribunales deben
integrar el principio de igualdad de trato y de oportunidades
entre mujeres y hombres en la interpretación y aplicación de
las normas. El presente estudio analiza la aplicación de la
perspectiva de género como canon de enjuiciamiento en la
doctrina de la Sala Cuarta del Tribunal Supremo referida a
cuestiones de Seguridad Social, ámbito en el que dicho
enfoque está deparando resultados muy relevantes, aunque
todavía insuficientes, que corrigen el impacto de los
estereotipos de género que tradicionalmente han mantenido
apartadas a las mujeres, en mayor o menor medida, del
mercado de trabajo y, por ende, subprotegidas por el sistema
público de Seguridad Social. ----------------------
By express legal mandate, courts and tribunals must integrate the principle of equal treatment and equal opportunities between women and men in the interpretation and application of the rules. This study analyses the application of the gender perspective as a canon of prosecution in the doctrine of the Fourth Chamber of the Supreme Court regarding Social Security issues, an area in which said approach is yielding very relevant results, although still insufficient, which correct the impact of gender stereotypes that have traditionally kept women away, to a greater or lesser extent, from the labour market and, therefore, under-protected by the public Social Security system
