Abstract
El presente trabajo estudia la naturaleza y configuración del parentesco como causa de discriminación en el ámbito laboral, y su trascendencia en materia de carga de la prueba y justificación de la medida. Asimismo, examina la repercusión del vínculo de parentesco en la empresa familiar, a efectos de la acreditación del móvil discriminatorio.
En lo que concierne a las consecuencias resarcitorias de la discriminación por razón de parentesco, se plantea la cuantificación de la indemnización por daños morales a la vista de la doctrina constitucional y judicial que permite la aplicación referencial de las cuantías previstas por la LISOS, así como de la exigencia legal de aportar las bases y criterios para determinar la existencia y entidad de los daños morales.
Por último, el estudio analiza el vínculo de parentesco como vehículo de discriminación “por asociación”, figura de construcción judicial que ha permitido ampliar subjetivamente la tutela antidiscriminatoria a sujetos en los que no concurre directamente la causa de la discriminación.
This work deals with the legal nature and configuration of the cause of discrimination due to kinship ties, and its significance in terms of burden of proof and justification of the employer’s measure. It also examines the impact of the relationship in view of the constitutional and judicial doctrine that allow the referential application of the amounts provided for the pecuniary sanction of those infractions typified by the LISOS, as well as the legal requirement to provide the bases and criteria to determine the existence and entity of moral damages. Finally, this study will analyse kinship relationship as a vehicle for discrimination by association, a figure of judicial construction that has allowed the extension of antidiscrimination protection to subjects in whom the cause of discrimination does not directly concur of kinship in the field of family business, regarding the discrimination test. Concerning the compensatory consequences of discriminatory decisions based on kinship, the quantification of compensation for moral damages is analysed
