- PublicationOpen AccessDesobediencia civil : sinergia entre teoría y práctica(2016-02-11) Zambudio Vivancos, María Josefa; Galindo Hervás, Alfonso; Departamento de FilosofíaEste trabajo de investigación ha tenido como guía los siguientes objetivos: en primer lugar se ha intentado demostrar que solamente en los Estados democráticos se puede hablar de la desobediencia civil como forma principal de disidencia. También se ha pretendido indagar sobre el origen y la idea de ciudadano, como sujeto de derechos, en las teorías políticas de la modernidad. Se ha procurado analizar el concepto de desobediencia civil en las principales teorías de autores actuales como Rawls, Habermas y Dworkin. Y así, partiendo de estas, tratar sobre la justificación de la desobediencia civil en el ámbito moral, jurídico y político. Finalmente el estudio de los casos prácticos, sin pretensiones de exhaustividad, se ha abordado con la intención de aclarar algunos errores sobre el fenómeno de la desobediencia civil y mostrar la diversidad de la acción, insertada en un contexto histórico determinado. La metodología empleada para un primer acercamiento al tema de la desobediencia civil se ha basado en la lectura de textos originales de los autores: libros, artículos, entrevistas etc. Con esto se ha pretendido obtener una primera opinión libre de prejuicios. Una vez anotadas las reflexiones sobre estas lecturas, se ha pasado a ampliar ideas a partir de textos relacionados con la temática en otros autores, intentando analizar, tanto aquellos que pudieran apoyar los objetivos propuestos, como otros que defienden opiniones contrarias. Debemos señalar que la gran mayoría de los textos consultados, aun no habiendo sido citados, han sido de gran utilidad para obtener una visión más amplia sobre el tema y que, en ocasiones, han servido para modificar la primera opinión que se tenía sobre el mismo, encauzando el curso de la investigación. Son varias las conclusiones a las que hemos llegado; la primera, basándonos tanto en las teoría como en la práctica, sería que la desobediencia civil es una forma de protesta propia de los Estados democráticos ya que los presupuestos que definen la propia acción coinciden con los de dichos Estados. La segunda es que, solamente cuando los hombres se consideran parte del sistema de poder, se encuentran en situación de actuar para conseguir un presente mejor. La tercera incide sobre la dificultad e inconveniencia de justificar la desobediencia en el ámbito jurídico, en tanto que, en el moral y el político son frecuentes los argumentos a favor de tal justificación. La cuarta y última pasa por aceptar que la sinergia entre las teorías sobre la desobediencia civil y la práctica de la misma enriquecen a ambos ámbitos, a la vez que generan nuevas formas de acción política. This research has been firstly aimed at proving that only in democratic states civil disobedience can be considered as the main form of dissidence. Furthermore, we have tried to investigate about the origin and the idea of the citizen, as subject of rights, through modern political theories. The concept of civil disobedience has been analyzed within the main theories by current authors such as Rawls, Habermas and Dworkin. Thus, from these premises, we will deal with the justification of civil disobedience in the moral, legal and political field. Finally, the study of practical cases, without claiming completeness, has been raised aiming at clarifying some mistakes about the phenomenon of civil disobedience, and at showing the diversity of actions inserted in a certain historical context. The methodology used for a first introduction to the topic of civil disobedience has been based on the reading of original sources: books, articles, interviews. In doing so, our attempt has been to elicit an initial opinion free of prejudices. Once notes of the reflections about these readings have been taken, we have broadened the ideas from other authors’ texts also related to the topic by means of analyzing not only those who could support the established targets but also others who defend views to the contrary. It must be pointed out that most of the texts consulted, not having yet been quoted, have been very valuable for the achievement of a wider vision about the topic and, occasionally, have been used to alter the initial opinion about it, guiding the research . We have reached several conclusions. Firstly, based on both theory and practice, civil disobedience is a form of protest found in democratic States since the presuppositions that define the action itself coincide with the ones in the States previously mentioned. Secondly, only when men consider themselves as part of the power system, they are able to act so that they can achieve a better present situation. Thirdly, the difficulty and inconvenience of justifying disobedience in legal fields, bearing in mind that arguments in favour of such a justification are frequently found. Fourthly, it is accepted that the synergy between the theories on civil disobedience and the practice of it enrich both fields, and at the same time new forms of political action are created.
- PublicationOpen AccessMemoria, cine y biopolítica : fragmentos para una genealogía de la memoria(2016-02-10) Burgos Mazas, José Miguel; Villacañas Berlanga, José Luis; Galindo Hervás, Alfonso; Departamento de FilosofíaAndreas Huyssen señalaba que el mundo se está musealizando y vive obsesionado con el pasado y la memoria. Lo que con Huyssen bien podríamos denominar como cultura de la memoria ha llevado a la pregunta por el recuerdo a cierto agotamiento. La reciente e imparable tendencia inflacionista de la memoria implicada en esa dinámica ha generado numerosos análisis, la mayoría de los cuales son sólo parcialmente satisfactorios cuando no directamente insuficientes. En este sentido vincular la cuestión de la memoria sobre una dimensión biopolítica ofrece no sólo una dimensión inédita sobre fenómenos actuales que, como la “judealización” de la memoria o la utilización del derecho como un instrumento de representación del pasado, marcan el paso de las sociedades democráticas actuales, sino también un marco idóneo desde donde plantear el alcance político del problema. El núcleo del trabajo se centra en el desarrollo del vínculo entre memoria y biopolítica con vista a arrojar luz en medio de un debate donde predomina una enorme confusión. En este sentido, basada en las indagaciones genealógicas de parte relevante de la filosofía italiana (Giorgio Agamben y Roberto Espósito), la primera parte de la investigación trata de dar a pensar la memoria como un dispositivo que se apropia del pasado a costa de excluir su vida; en otras palabras, de pensar de qué manera se inscribe el cuerpo cuando hacemos una operación de memoria. Asimismo, en la medida de esa operación constituye el lugar de la soberanía y produce la humanidad del ser vivo, su estatuto es inseparable de la máquina antropogenética que procede mediante el gesto mismo de la inscripción de lo animal en la polis, por el que se constituye el yo que recuerda. Por otro lado, el otro frente de análisis es de signo histórico-genealógico y tiene como labor esencial poner en relación la especificidad y el alcance de la hipótesis propuesta con una constelación de autores que directa o indirectamente se hacen cargo del mismo problema. Esto no quiere decir que esta búsqueda quiera confirmar la infabilidad de la tesis propuesta. Más bien al contrario, plantearlo así permite por un lado penetrar en la cuestión desde otros ángulos haciendo posible de ese modo introducir una perspectiva crítica, y por otro, sugerir la posibilidad de anclar genealógicamente el problema en una tradición, atendiendo, claro está, a la especificidad y relevancia del modo en el que esta tradición se manifiesta. Todas estas reflexiones requieren un aparato teórico que tenga como principal característica un diálogo fértil con una buena parte del pensamiento contemporáneo, en particular con todos aquellos que prestan una mayor atención a sus registros políticos y genealogico-políticos. Dado que la cuestión de la memoria no es originaria y está íntimamente ligada al arte de contar historias, se analizarán los soportes narrativos que, desde sus diferentes dominios, den cuenta de esta problemática. Entre ellos el trabajo se hace cargo de una fuente fundamental, el cine, mediante la cual rastrearemos los términos en los que la relación ente la memoria y la imagen tiene o no una repercusión política directa. SUMMARY MEMORY, CINEMA AND BIOPOLITICS Fragments for a genealogy of memory José Miguel Burgos Mazas. University of Murcia Andreas Huyssen noted that the world is musealized and obsessed with the past and memory. What with Huyssen well we could call memory culture has led to the question of the recall certain exhaustion. Recent unstoppable inflationary trend of memory involved in this dynamic has generated numerous analyzes, most of which are only partially satisfactory if not downright inadequate. In this sense link the issue of memory on a biopolitical dimension offers not only an unprecedented dimension on current phenomena such as memory prosecution or use of law as an instrument of representation of the past, set the pace of the today's democratic societies, but also an ideal framework to raise the political scope of the problem. The core of the work focuses on the development of the link between memory and biopolitics with a view to shed light in the midst of a debate where enormous confusion prevails. In this sense, based on genealogical inquiries from relevant part of the Italian philosophy (Giorgio Agamben and Roberto Esposito), the first part of the research is to think of memory as a device that appropriates the past at the expense of excluding its life; in other words, to think how the body falls when we make a memory operation. Also, to the extent that operation constitutes the place of sovereignty and produces humanity of the living, their status is inseparable from anthropogenetics machine that comes through the act itself of registration of the animal in the polis, by which the self is reminiscent. On the other hand, the other front analysis is of historical and genealogical sign and its essential work to relate the specificity and scope of the proposed hypothesis with a constellation of authors that are made directly or indirectly by the same problem. This does not mean that this search want to confirm the infallibility of the thesis proposal. Quite the contrary, this way allows penetrate the matter from other angles enabling thereby enter a critical perspective, and on the other, suggest the possibility of anchoring genealogically the problem in a tradition, based, of course, to the specificity and relevance of the way in which this tradition is manifested. All these considerations require a theoretical device that has as main feature a fertile dialogue with much of contemporary thought, particularly those who pay more attention to their political and genealogical and political records. Since the question of memory is not original and is closely linked to the art of storytelling, narrative supports from different domains, realize these problems are discussed. Among them we can distinguish one main sources, film, through which will track the terms in which the entity relationship memory and the image is or is not a direct political impact.

Objetivos de la tesis La tesis comprende una serie de lecturas y análisis sobre diversos estudiosos de la figura histórica o mítica de Moisés. El fenómeno inédito de Moisés en el monte Sinaí ha sido analizado por teólogos y filósofos. Este trabajo intenta mostrar cómo no encontramos interpretación alguna sobre Moisés (realizada entre la Edad Media y la época moderna) exenta o desprovista de disertaciones políticas. Analizar los hechos acaecidos en el monte Sinaí se convirtió para muchos audaces pensadores en una cuestión política. Los fundamentos teóricos de la democracia dependieron de la creatividad de un filósofo, Spinoza, para recrear los hechos acaecidos en el monte Sinaí. Por tanto, en este trabajo, nos vamos a mover en tres planos. El primero, la interpretación de los hechos acaecidos en el monte Sinaí que propone cada autor. El segundo, la motivación o la explicación de por qué ese autor ve los acontecimientos del monte Sinaí de ese modo y no otro, cuál es la intención que subyace a cada interpretación. Una interpretación que se ubica en un universo psicosocial y, sobre todo, en una época y una sociedad que se enfrenta a problemas y desafíos políticos diferentes. La tercera, cómo esas interpretaciones recrean nuevas imágenes, dotadas de carga política, que pretenden establecer nuevas relaciones de dominio y poder. Debido a que la tesis se mueve en tres planos de comprensión diferentes, responde a tres exigencias teóricas diferentes. La primera respecto a la génesis y comprensión de los conceptos políticos modernos. Más concretamente, al problema de si podemos comprender los conceptos políticos modernos al margen del proceso de la secularización. El segundo se pregunta por cuáles son los fundamentos teóricos de la democracia moderna, a partir del estudio del TTP de Spinoza. El tercero se plantea si podemos hablar de la construcción de un sujeto afín a la democracia que esté vacunado contra el dominio imperial. 2. Metodología Estamos ante una investigación de naturaleza compleja. La labor principal ha consistido en hacerse con los procesos socio-históricos de naturaleza política, y centrados en las luchas de poder de la época moderna, tema que constituye el eje principal de la tesis. El juego de categorías de la época moderna, centradas sobre todo en el análisis de la figura de Moisés, lo hemos desplegado desde una perspectiva histórico-conceptual, que nos ha permitido retroceder a la época medieval y avanzar hasta la época post-moderna. La historia conceptual, como metodología científica, nos permite desvelar el dispositivo categorial específico de la filosofía política moderna, frente a los que constituye bien el cosmos de la primera modernidad o bien del mundo mental medieval. 3. Conclusiones: -Los conceptos políticos modernos no pueden comprenderse al menos en su total complejidad al margen del proceso de secularización -Los fundamentos teóricos de la democracia moderna se deben en parte a la secularización del mesianismo judío y de los componentes que lo integran, siendo estos: profeta, profecía, estado mesiánico y redención, que se van a traducir por revolucionario, mitin político, estado democrático y destino final del pueblo o consecución de la anhelada paz del Estado. -Los fundamentos del estado moderno, así como la creación de un sujeto afín a la democracia y contario al imperio, no se puede comprender al margen de las interpretaciones heterodoxas judeo- cabalísticas- helenísticas, que fueron gestando a lo largo de la historia nuevas formas de comprender el poder, a partir de la interpretación histórico sociopolítica de los hechos sucedidos en el monte Sinaí. 1. Purposes of this thesis The thesis comprises some reads and analyses on diverse scholars of the historical or mythical figure of Moses. The unprecedented phenomenon of Moses at MountSinai has been analysed by theologians and philosophers. This essay attempts to show how we do not find any interpretation about Moses (between the Middle Ages and the modern age) exempt or devoid of political dissertations. The analysis of the events that took place at Mount Sinai turned intoa political issue for many audacious thinkers. The theoretical foundations of democracy depended on the creativity of a philosopher, Spinoza, to recreate the events that took place at Mount Sinai. Therefore, in this essay, we will study three areas. The first one is the interpretation of the events that took place at Mount Sinai that every author proposes. The second one is the motivation or explanation of why this author sees the events of Mount Sinai that way and only that way, which intention is behind every interpretation;an interpretation that is placed in a psychosocial universe and, above all, in an age and society that face different political problems and challenges. The third one is how these interpretations recreate new images, politically charged, that intend to establish new relations of domination and power. As this thesis studies three different levels of understanding, it responds to three different theoretical requests. The first one is about the origin and understanding of modern political concepts. More specifically, about the problem of whether we can understand modern political concepts outside of the process of secularization. The second one wonders about the theoretical foundations of modern democracy, starting from the study of Spinoza’s TTP. The third one thinks about whether we can talk about the creation of a subject in favour of democracy that is prepared against imperial domination. 2. Methodology We face a complex research. The main task lied in getting hold of the socio-historical processes witha political nature that were focused on the power struggles of the modern age, subject that constitutes the main focus of this thesis. We have displayed the set of categories of the modern age, mainly focused on the analysis of Moses’ figure, from a historical and conceptual point of view, that allowed us to go back to the Middle Ages and advance until the postmodern age. Conceptual history, as a scientific methodology, allows us to reveal the specific categorymechanism of modern political philosophy, against those that the cosmos of the first modernity constitutes well, or of the medieval mental world. 3. Conclusions: -The modern political concepts cannot be understood, at least in their whole complexity, outside of the process of secularization. -The theoretical foundations of modern democracy are partly due to the secularization of Jewish messianism and the components that integrate it, that is: prophet, prophecy, messianic state and redemption, that are translated into revolutionary, political speech, democratic state and final destination of the people or achievement of the desired peace of the State. -The foundations of the modern state, as well as the creation of a subject in favour of democracy and against empire, cannot be understood outside of the heterodox Judeo-Kabbalistic-Hellenistic interpretations that were originating new ways to understand power throughout history, starting from the socio-political historical interpretation of the events that took place at Mount Sinai.
